Terms of Service

These Terms of Service (“Terms”) govern your use of the KIP TV Network website at kiptv.network, the KIP TV Network streaming service and related viewer destination, any KIP TV applications, pages, programs, contact forms, social-media pages we control, pay-per-view offerings, and other services that link to these Terms (collectively, the “Services”).

“KIP TV,” “KIP TV Network,” “Knowledge Is Power Network,” “we,” “us,” and “our” mean KIP TV Network, a Texas limited liability company. If you use the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Who may use the Services

You may use the Services only in compliance with these Terms and applicable law. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian. Some programs, events, features, or purchases may have additional eligibility requirements.

You are responsible for the internet connection, compatible device, account, and third-party platform access needed to use the Services. KIP TV does not guarantee that every feature will work on every device, browser, operating system, television platform, or location.

2. Acceptable use

You agree not to use the Services to:

  • Break any law, regulation, court order, or third-party right.
  • Interfere with or disrupt the Services, servers, networks, security measures, or other users.
  • Attempt to access accounts, systems, content, or data that you are not authorized to access.
  • Copy, record, reproduce, redistribute, sell, rent, sublicense, publicly display, publicly perform, transmit, or exploit KIP TV content except as expressly permitted by KIP TV or applicable law.
  • Remove, alter, obscure, or bypass copyright notices, trademarks, watermarks, access controls, advertising, or technical protections.
  • Use automated means to collect data or content from the Services without our written permission.
  • Upload, submit, post, or transmit material that is unlawful, defamatory, threatening, harassing, invasive of privacy, deceptive, hateful, sexually explicit, infringing, or otherwise inappropriate.
  • Impersonate another person or organization, misrepresent an affiliation, or falsely state that KIP TV endorses you, your content, or your views.
  • Use the Services for commercial solicitation or advertising unless KIP TV has approved it in writing.

We may suspend, restrict, remove, or terminate access to the Services when we reasonably believe these Terms have been violated or when necessary to protect KIP TV, viewers, partners, or the public.

3. KIP TV content and intellectual property

The Services, including their design, text, graphics, logos, show names, video, audio, programming, artwork, photographs, clips, software, compilations, and other content made available by KIP TV (collectively, “KIP TV Content”), are owned by KIP TV or its licensors and are protected by copyright, trademark, and other laws.

Subject to these Terms, KIP TV gives you a limited, personal, revocable, nonexclusive, nontransferable right to access and view KIP TV Content for your personal, noncommercial use through the Services. This permission does not transfer ownership of any KIP TV Content to you.

“KIP TV Network,” “Knowledge Is Power Network,” and KIP TV logos, names, and identifying marks may not be used without KIP TV's prior written permission, except for nominative use permitted by law. Nothing in these Terms grants you a license to use any KIP TV trademark.

4. User submissions and content you provide

The Services may allow you to send messages, contact-form entries, ideas, comments, photographs, video, audio, show proposals, creator materials, school-partnership materials, testimonials, or other material (“User Submissions”). You retain any ownership rights you may have in your User Submissions, subject to the license below.

By sending a User Submission to KIP TV, you represent and warrant that: (a) you own it or have all rights, permissions, releases, and authority needed to send it and grant the license below; (b) it does not violate these Terms or any law; (c) it does not infringe, misappropriate, or violate another person's intellectual-property, privacy, publicity, confidentiality, or other rights; and (d) information you provide is accurate to the best of your knowledge.

Except for materials governed by a separate written agreement, you grant KIP TV a worldwide, nonexclusive, transferable, sublicensable license, without payment of royalties, to host, store, reproduce, modify for technical formatting, adapt, translate, publish, distribute, publicly display, publicly perform, communicate, and otherwise use your User Submission as reasonably necessary to operate, promote, improve, and provide the Services and to evaluate, discuss, and administer the request or opportunity for which you submitted it. If KIP TV and you enter a separate written agreement, that agreement controls to the extent it conflicts with this section.

Do not submit confidential information, unreleased creative work, sensitive personal information, or material you do not want KIP TV to review or use for the purpose of responding to your request unless KIP TV has agreed in writing to receive it under appropriate terms. We are not obligated to review, preserve, publish, return, or compensate you for a User Submission unless a separate written agreement says otherwise.

5. Sponsorship, production, school, and creator inquiries

Submitting an inquiry does not create a sponsorship agreement, production agreement, employment relationship, school partnership, creator partnership, editorial commitment, or obligation by KIP TV to purchase, distribute, publish, produce, or carry any content. Any sponsorship, production, school, creator, or other business relationship must be confirmed in a separate written agreement signed or otherwise expressly authorized by KIP TV.

KIP TV may apply technical, editorial, legal, brand-safety, rights-clearance, scheduling, and business criteria when considering programs, submissions, advertising, and partnerships. KIP TV may decline or discontinue content or a proposed arrangement at its discretion, subject to any executed written agreement.

6. Third-party platforms, links, and availability

KIP TV content may be available through third-party platforms and devices, including Roku, Fire TV, Apple TV, Android TV, Google TV, the Orocast OTT platform, app stores, payment processors, social-media services, and other providers. Those services are owned and operated by third parties and may have their own terms, privacy policies, availability rules, technical requirements, or geographic restrictions.

KIP TV does not control and is not responsible for third-party services, their content, availability, policies, security, device compatibility, or actions. Your use of a third-party platform is governed by that platform's terms. References or links to a third-party service do not mean KIP TV endorses it.

We may change, interrupt, limit, remove, or discontinue any portion of the Services at any time, including programming, features, platform availability, and supported devices. We will try to address material operational issues reasonably, but we do not guarantee uninterrupted, secure, errorless, or always-available access.

7. Pay-per-view purchases and refunds

From time to time, KIP TV may offer an event, program, recording, access pass, or other item for a one-time purchase (“Pay-Per-View Purchase”). Purchase terms displayed at checkout, on an event page, or in a separate purchase agreement are incorporated into these Terms.

Before completing a Pay-Per-View Purchase, you are responsible for reviewing the event description, access window, device requirements, price, taxes, and any stated restrictions. You authorize KIP TV or its payment processor to charge the payment method you provide for the disclosed amount.

Unless required by law or unless KIP TV states otherwise in writing, Pay-Per-View Purchases are final and nonrefundable after access has been provided, the event has started, the recording has been made available, or a redemption code has been delivered. If a verified technical failure caused by KIP TV prevents you from accessing a purchased event during the stated access window, contact us at tony@kiptv.network within seven days of the event or attempted access. We may investigate and, where appropriate, offer a remedy such as alternate access, a replacement, account credit, or a refund at our discretion and as required by applicable law.

KIP TV is not responsible for access problems caused by your internet connection, device, third-party platform outage, unsupported software, incorrect account information, or circumstances outside KIP TV's reasonable control. Chargebacks or payment disputes should be raised with KIP TV first when possible so we can review the issue.

8. Copyright complaints

KIP TV respects intellectual-property rights. If you believe material on the Services infringes your copyright, send a written notice to tony@kiptv.network with the subject line “Copyright Notice.” Include: (1) your name and contact information; (2) identification of the copyrighted work; (3) the location of the material you believe infringes; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act for the owner; and (6) your physical or electronic signature.

We may remove or restrict access to material in appropriate circumstances and may forward your notice to the person who submitted the material. If you believe material was removed in error, contact us with supporting information. This process does not limit any rights or remedies available under law.

9. Disclaimers

THE SERVICES AND KIP TV CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, KIP TV DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

KIP TV does not warrant that the Services will be uninterrupted, timely, secure, errorless, without harmful components, or suitable for your needs. KIP TV Content is provided for general information and entertainment. It is not legal, medical, financial, mental-health, tax, or other professional advice. You should seek advice from a qualified professional for decisions that require it.

Views expressed by guests, sponsors, creators, commenters, or other third parties are their own and do not necessarily reflect the views of KIP TV. KIP TV does not guarantee the accuracy, completeness, or usefulness of third-party statements or content.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KIP TV AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, PARTNERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, KIP TV'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO KIP TV FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

11. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless KIP TV and its members, managers, officers, employees, contractors, licensors, partners, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from or related to your User Submissions, your use of the Services, your violation of these Terms, or your violation of another person's rights. KIP TV may assume control of the defense of a matter subject to indemnification, and you agree to cooperate with that defense.

12. Governing law and venue

These Terms and any dispute arising from or related to them or the Services are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Except where applicable law requires otherwise, you and KIP TV agree that the state and federal courts located in Jefferson County, Texas, will have exclusive jurisdiction over any dispute, and you consent to personal jurisdiction and venue in those courts.

13. Changes to the Services and Terms

KIP TV may update these Terms from time to time. When we do, we will post the updated Terms on this page and revise the Effective Date. If a change is material, we may provide additional notice when reasonably appropriate. Your continued use of the Services after updated Terms take effect means you accept them. If you do not agree to the updated Terms, stop using the Services.

14. Other legal terms

These Terms, together with any terms presented for a specific feature, event, purchase, or written agreement, are the entire agreement between you and KIP TV regarding the Services, except where a separate written agreement states otherwise. If any provision is held unenforceable, the remaining provisions remain in effect. KIP TV's failure to enforce a provision is not a waiver. You may not assign these Terms without KIP TV's written consent. KIP TV may assign these Terms as part of a merger, reorganization, asset transfer, or similar transaction.
